Delivery of goods from Italy

Vitta-Trans LLC offers a full range of services in the field of international transportation of export-import cargo. Regulatory Standards

The activities of our company, including the delivery of goods from Italy, France, Spain and the transportation of goods from Poland, are regulated by the Convention on the Contract for the International Carriage of Goods by Road (CMR). The document was adopted on 05/19/1956 in Geneva, entered into force on 07/02/1961 and has the status of a UN Convention. The CMR was signed by Poland, Spain, France, Italy, Latvia, Bulgaria and other countries in Europe and Asia. The purpose of the Convention is to regulate relations arising in the process of international transport.

Registration of the CMR

In accordance with the CMR, the contract of carriage from Italy, Spain, France or Poland is established by a consignment note. The loss, incorrect execution or absence of this document does not affect the validity or existence of the delivery agreement. The invoice must be drawn up in 3 originals, which are signed by the shipping company and the sender. The first copy remains with the sender, the second one accompanies the goods, the third one remains with the carrier delivering cargo from Italy, Poland, France, etc. If delivery is carried out on different vehicles or groupage cargo is transported from Poland or, for example, Spain, the sender may require the preparation of more copies of invoices (by the number of vehicles or consignments of goods).

  • Date and place of registration.
  • Address and name of the sender of the groupage cargo from Italy.
  • Address and name of the company carrying out cargo transportation from Poland.
  • Date and place of acceptance of the combined consignment of goods.
  • Place of delivery of goods.
  • Recipient’s address and name.
  • Designation of the nature of the groupage cargo delivered from Italy, type of packaging, quantity.
  • Number, markings and numbers of cargo packages.
  • Costs associated with transport from Italy or transport from Poland.
  • Instructions for transport from France, Spain or another country.
  • An indication that the transportation is carried out in accordance with the requirements of the Convention.

Carrier liability

In case of damage or loss of cargo. The company delivering cargo from Italy is responsible for partial or complete loss of the consolidated cargo and for its damage that occurred during the period of time between the acceptance of the goods by the carrier and its delivery to the destination. The carrier also bears financial responsibility if delivery occurs late. If the groupage cargo is damaged, the company responsible for the delivery of the cargo from Spain is obliged to pay an amount corresponding to the depreciation of the goods, which is calculated according to its value.

In case of force majeure. A company transporting groupage cargo from Spain is exempt from liability if the loss, damage to the goods or late delivery were caused by circumstances that the carrier could not avoid and the consequences of which he could not prevent. The company transporting goods from Italy, France or groupage from Spain has the burden of proof that the damage, loss of goods or late delivery was caused by force majeure.

Cargo owner rights

Recognition of loss of goods. The client who ordered cargo transportation from Italy or delivery of consolidated cargo from Poland has the right, without presenting evidence, to consider the goods lost if they were not delivered within 30 days after the end of the established period or, if such a period is not specified, within 60 days from the date of acceptance goods by the carrier.

Return of goods considered lost. The client, upon receipt of compensation for cargo lost during transportation from France or transportation from Poland, may request in writing for its immediate return if within a year following the payment of compensation. A client who has ordered the transportation of groupage cargo from Italy, cargo from Spain or transportation from France, within 30 days from the date of receipt of notification of the location of the goods, may demand its release upon payment of debt obligations that follow from the invoice.
